Pearland Employment Lawyer

As an employee of a Texas company, you have certain rights. You have the right to be free from discrimination and harassment, you have the right to fair and equal pay, you have the right to take protected medical leave, and you have the right to be appropriately compensated after a workplace injury. When employers refuse to adhere to these rights, you have the right to bring legal claims against your employer and other responsible parties. The Texas employee rights lawyer at Keith B. French Law, PLLC is ready to help.

The Firm’s Pearland employment lawyer will help you file for workers’ compensation, bring a personal injury claim against your employer, investigate your claims of harassment and discrimination, and otherwise protect your rights as a Texas employee. Employment law attorney Keith B. French Jr. founded Keith B. French Law in order to level the playing field for everyday Americans and make sure that they get their fair shake under the law. Keith B. French Law fights for your rights as a worker and wage-earner, whatever the charge. This Firm puts people first.

Texas Workers’ Compensation

Workers’ compensation is a form of insurance carried by employers that covers the medical costs and lost wages of employees who contract illness or injury at the workplace. Employees can obtain necessary medical coverage without fear of breaking the bank, and employers are more secure in the knowledge that workers will (a) get the medical care they need to heal and return to work, and (b) will have an exclusive remedy for a workplace injury that removes the need to sue the employer for their injuries. Employers who have workers’ comp cannot typically be sued by employees for workplace accidents.

Unlike some states, however, Texas law does not require all employers to carry workers’ compensation insurance. According to the Division of Workers’ Compensation (DWC), over a quarter of all private employers do not carry workers’ compensation coverage, representing close to 20% of the private workforce across the state. Employers who do not carry workers’ comp, called “non-subscribers,” must notify employees that they do not carry insurance.

If your employer does not have workers’ comp coverage, then you are free to file a lawsuit against your employer for work-related injuries. In fact, employers are not permitted to argue that the injured employee’s negligence contributed to the accident, that another employee’s negligence caused the injury, or that the injured employee “voluntarily accepted the risk” of injury by taking the job. Non-subscriber employers can be liable not only for medical costs and lost wages, but additional personal injury damages as well.

If your employer has a workers’ comp policy, Keith B. French Law can help you with your available benefits and ensure you get the medical treatment you need. If your employer refuses to carry workers’ comp, Keith B. French Law will help you bring your claims after a work-related injury and recover the available damages. You have the right to compensation for your workplace injuries, one way or another, and Keith B. French Law can help.

Texas Workplace Discrimination & Harassment

State and federal laws both prohibit discrimination and harassment in the workplace. Employees cannot be targeted with any negative workplace consequence or behavior as a result of their religion, race, color, gender, national origin, disability, pregnancy, age, or other protected characteristics. Nor can employers retaliate against employees for filing discrimination or harassment charges or for participating in another employee’s legal proceeding.

Texas employees are protected by federal laws including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Pregnancy Discrimination Act, and the Americans with Disabilities Act. Texas law, including the Texas Commission on Human Rights Act, also prohibits discrimination in the workplace. If you were fired, demoted, denied compensation, or denied a job because of your membership in a protected class, you have the right to fight back against the company’s conduct. If you have experienced a hostile workplace or harassment due to your race, gender, or some other protected characteristic, you have rights as well. Employment Law FAQ

If you or a loved one are in need of legal counsel regarding an employment issue, contact a Pearland, TX employment lawyer at a law firm you can trust, Keith B. French, PLLC. Workplace disputes can seem overwhelming and difficult to solve, however, with the right legal representation, employment issues can be resolved in a clear, and peaceful manner.

What is employment law?

Employment law encompasses anything pertaining to the workplace. Employment law is often used for harassment, discrimination, wrongful termination, and compensation disputes.

How can an employment lawyer help their clients?

Employment lawyers can help their clients in a myriad of different ways. When a client first believes that there may be an issue in the workplace, they should contact an employment lawyer whom they can trust. During the initial consult, the clients will disclose the information pertaining to their workplace issues. The employment lawyer will then formulate a legal plan of action, looking out for the needs of the client. The client should not feel alone in their discrimination, but supported by their attorney every step of the way. A Pearland employment lawyer provides legal counsel, as well as protection for their client emotionally, and physically as well. If a client is in a dangerous workplace environment, their employment lawyer will work hard to ensure safety.

What should clients look for in their employment lawyer?

Not all attorneys will provide legal counsel, support, and representation while respecting their clients, displaying clear communication, and looking out for their client’s best interests. Unfortunately, some attorneys, even employment lawyers are self-serving and only interested in money, or prestige. Thankfully, the skilled team at Keith B. French, LPPC are not only experienced in employment law but will respect, advocate and fight for the rights and freedoms of their clients as well.

How should employers and employees be treated in the workplace?

Many workers do not fully understand what their rights are when it comes to employment issues. Rather than suffer in silence, or decide to quit, frustrated and exploited employees should seek assistance from an employment lawyer. An employment lawyer has the proper training in state employment law, as well as the experience needed to ask the right questions and advocate on behalf of their employee. No employee or employer should have to suffer a hostile, unfair, exploitative, or discriminative workplace environment.

Sadly, many think it is okay to treat employers or employees in this matter. The cycle will continue if justice and accountability are not fought for. Taking legal action for discrimination and unfair bias is brave. Those who choose to pursue justice for themselves can not only change their work environment, but many other’s as well in the organization. When workplace issues are dealt with, it allows employers and employees to work in harmony, without the threat of harassment and abuse. Be a part of something bigger than yourself, and report unfair workplace environments.

If you suspect a workplace issue and are in need of legal counsel, contact a Pearland employment lawyer at Keith B. French, LPPC today to schedule a risk-free consultation.
